In this situation, yes, we were dealing w/ MH. But it was Yazsoft who had the intent to deceive and who profited from that deception. Plus, once a product has changed hands, warranties etc are usually with the manufacturer. The responsibility shifts.

So while MH is working on our behalf - and I have been given no reason to distrust MH - it is Yazsoft who has been the bad guy. Clearly. MH might be able to get us our licenses. But only Yazsoft can fix their own reputation. So far, there are no signs that that is important enough to them.

First complainant (in this case MacHeist) needs to prove that there was malicious intent before such accusations can be stated. I would be very careful in making such statements since in worst case scenario they can become very costly if made without merit. Regarding the shift of responsibility its only possible if there is an agreement between the reseller, distributor and / or manufacturer. This is common practice in warranty cases. However, even then consumer has option of making a complaint / pursuing legal action against retailer if they choose to. Anyway, in this case manufacturer is stating that there is no free upgrades according to their agreement between MacHeist. However, MacHeist has promised that all the licenses are full and therefore they need to deliver them to us. Actually its very simple case.

YazSoft is being SO childish about this. It is so simple to just upgrade us all! Why the big hassle?

Lawyers can go that route. I'm really not that interested in what would happen in court. I have no idea who would win anything if litigation happened, or even if we, the customers would ever be happy.
The point I have tried to make in most of my comments is that this is a customer relations fiasco. And Yazsoft has made enough mistakes to leave a bad taste in my mouth. They may make great software but so do some other companies who may be more responsive to my needs. My perception is that I might be happier with some other product.
FWIW  - the court of public opinion is important - there are many valid points of view.
I am satisfied with the snippets and explanation of Johnred. I have seen confusing versions and stories out of Yazsoft. A lot of finger pointing all over.
This is a perception battle. Yazsoft has damaged themselves by having only a short term view. Whether or not we ever get SD5, they have lost many customers and their friends. And that is the true cost of their actions.

I'll also add my thank you for John for the update! Hopefully it doesn't have to end up in court and we can all move on.

One idea, when it DOES get resolved, could the directorate send out an email? Not everyone checks the boards..

Thanks,

Thanks for the MH statement.  I had not installed SD until this week and when I did I found out what had happened and I was disappointed.  I had never heard of their app, so I can't say I will miss it, but I am glad you introduced me to the other great apps like Vector Designer and Pxelmator.

I didnt participate on the missions (except for 1 bec I read the combination somewhere), that's actually what led me to the bundle.

Anyway, since then I found out that other great apps were part of the mission loots.  Would it be possible for us who didnt know about all the missions to get access to those apps as a good will gesture for the SD fiasco?  I am really interested in Mousepose for example and I know it's an app I could use a lot.

Thanks again for the official statement.

I see there are many views about this but...

In my view Everything Yazsoft did until today was a desperate act of cashing on the MacHeist customers.

Every act, every step they did during this fiasco was aimed  at making money exclusively from MacHeist customers.

I will not state that this is malicius intent. They just saw business opportunity and they thought this approach is best for their business.

Well, of course I disagree but that are their decisions to be made, mine is that I will not buy anything from that company anymore.

The manufacturer in this case presented something which was critically different, after the fact, than the assumed agreement that was reached between them and MacHeist. MacHeist thought that they were getting licenses which were the same as they would be had their customers bought them from Yazsoft directly. Yazsoft, evidently, thought differently. Both sides have acknowledged they have made mistakes, and both sides are working on a solution.

How many times does this need to be repeated?

Actually its very simple case.

Simple, if all you really have is an axe to grind against other people, whether it be MacHeist or Yazsoft.

Yes, and John discussed this - the "activation" scheme was what seemingly differentiated our version of SD from a "conventional" version of SD, and it was what made them suspicious of it in the first place.

This really comes across to me as just another excuse for people for use against the Directorate, as if they have some sort of personal vendetta against John. Ridiculous.

I’m sorry you perceived it that way.
You conveniently forgot to quote: “But in all fairness Phil’s post involves more than that”

I have nothing against the directorate, MH, or John.
(Full disclosure: I never liked iClip 4 and John and I got into some arguments about it. iClip4 has not changed since its release, and these days I’m a happy user of PTH Pasteboard).

Ridiculous indeed.

I wonder what yazsoft's thoughts were on doing this, did they think we just wouldn't notice, or did they act with malicious intent trying to make a quick buck?  I believe its a little of both, they were trying to make some money fast and was hoping that we would just go along with it

I would be happy if they just gave us a license to SD5 and not offer an upgrade price to SD6 for the licenses we get.  We don't get dated software and they get more money from loyal users when the time comes.  The current situation makes me feel like they snuck loot into the bundle.

After solid assurance from Yazsoft about all this, we then decided to put Speed Download back into the bundle as a bonus for you.

While I understand and respect your decision not to publish Yazsoft's reaction (it might even be illegal), I regret to say that you still haven't shown any proof that Yazsoft is to blame fully for this mess and you not at all: notwithstanding your very long explanation, it hinges on just this "solid assurance" that you mention, and for that we have only your word to go on.

Bob, I don't know why you would want to give everyone a false impression with a partial quote. It is very misleading. For everyones sake here is Phil's FULL quote:

Um, all of these licenses are 'full' licenses. The only arguable exception I suppose is SD, which must be activated on a promo build with no other differences. However, you have a whole six months to do so, and past then, YazSoft will have updated promo versions available.

The link is here:

http://www.macheist.com/forums/viewtopi … 266#p92266

Please, lets not play these games, it isn't very helpful. Let's all remain helpful here.

To me this means that the only difference is about the fact that it is a promo build, and that promo versions will also be updated. Later there was a statement about the fact that one could even update using non-promo versions.
But, not a word about a difference in terms and conditions of purchase.

Possible solution?
All the solutions mentioned so far by Yazsoft and others have been unsatisfactory because they do not treat the MH licenses as full normal licenses.
My personal take on Yazsofts' stance is that they need a cash infusion very badly right now so maybe they also feel backed into a corner by their private survival fears.

So the solution must include a free full upgrade for MH purchasers and an influx of cash for Yazsoft.

I propose some version of this:
Yazsoft immediately offers full upgrades to MH users for free.
At the same time they could offer - for a limited time only - full lifetime (or limited# of versions) of SD.
If they have a new product in the wings (right now they are a one product show) they could release a limited version sooner or a Beta and a pre-order offer.

Edit: You'll notice that any solution has to be done by Yazsoft.

There is an even simpler solution if Yazsoft wants to take it.  They should make the SD4 to SD5 upgrade a donationware upgrade for their customers who bought through MacHeist.

Offer their customers the option to pay ($0, $5, $7.50, $10, $12.50 or $15) for the upgrade.  Let the customers decide who to believe.  And if the customers pay the full $15, then honor the 2:1 offer.

Funny, my wife said the same thing. I just think it may be too late for this now since so many people are so upset. I would donate to it, I just don't think a lot of people would.

Money. They do not want to go broke, but it seems that they risk their face. In fact, it would be a pity to see them go out of business - having skilled developers is always a good thing per se.  This said, Yazsoft should have waited at least another month, and released a maintenance version for SD 4 with one or two minor bug fixes, just to give a better impression.

I can sort of understand what they did (not that I do approve of it, or condone it, but I understand it). The *way* of doing it was the major blunder, in my opinion.

I've emailed YazSoft, and I've not had the luck that others have mentioned. They've replied to two of my emails, rejecting my requests for a free upgrade. The first one only contained the license info, and the second clarified that I purchased the app during the free upgrade grace period. I got the company line on MH2 customers not being eligible. So, I sent a much lengthier email stating my case for a (well deserved) free upgrade. We'll see (but no response yet, and the first two were pretty snappy responses).

Perhaps they're choosing to IGNORE the customers who don't play by their rules.

I have never used SpeedDownload until I bought the MH Bundle.  I installed it and I really like it but after what I have read here and several other threads, I don't care so much for SpeedDownload anymore.
Sure the app itself is great and I would probably be paying for future upgrades past SD5 but as of now I am not so sure any more.

MH is a good way for developers to get their product more known among Mac users in a GOOD way but now it is just doing the opposite for SpeedDownload!!!

Even if SpeedDownload decides to offer SpeedDownload 5 for free for the MH Bundle(like it should have done in the first place), they will have to do A LOT MORE to earn my dollars and trust for any future upgrades!!!

John,
Thanks for the updates and letting us know the real story!
